W. Daniel Pate is a partner in the law firm of Pate & Scarborough in Pinehurst, NC. Mr. Pate received a B.S. degree in Business Administration from the University of North Carolina at Chapel Hill in 1971 and a Juris Doctor (law degree) from Wake Forest University in 1974 where he was on the Law Review. He has been in the private practice of law in Moore County for over 25 years and concentrates his practice in the areas of real estate and estate planning. He represents clients in both residential and commercial real estate transactions.

He is a member of the North Carolina State Bar, the North Carolina Bar Association, the Real Property Section of the NC Bar Association and the National Academy of Elder Law Attorneys. He and his wife live in Southern Pines where they are active members of the Southern Pines United Methodist Church. Mr. Pate is President of the Southern Pines Rotary Club for 2001-2002.

Do you really need a lawyer for your real estate closing?

Unlike other states, North Carolina still has significant attorney involvement in residential real estate transactions. The attorney performs a title examination at the courthouse for the property and reports his attorney's opinion of title to either the lender or title insurance company involved in the transaction. The attorney's job is to be sure that the buyer gets a clear title and that the lender has a valid mortgage on the property if a loan is involved. The attorney also serves as the settlement agent in real estate closings in North Carolina by collecting all of the money for the closing and disbursing those funds to the proper parties.
